That evening, Taylor Auxiliary Reserve Lt. Danny Kromer stopped near the city of Monroe on westbound I-94 with his partner, Auxiliary Officer Timothy Justus, in order to aid a driver on the shoulder of the freeway. Kromer walked around to the driver’s side of the vehicle whose owner they were assisting when Delpiano’s car reportedly hit the Taylor officer, who later died.

The breakdown of Delpiano's sentence includes 45 to 67.5 years on the second-degree murder charge. He also received concurrent sentences of 15 to 30 years on the following charges: operating a vehicle on a suspended license; failure to stop at the scene of an accident in which he was at fault; and failure to use care when passing an emergency vehicle.
