UPDATE: ACLU Says Jones Ruling Was 'Blatantly Unconstitutional'
The Florida pastor left for home Saturday morning, but vows to come back to have his protest in front of Dearborn's City Hall.
Florida Pastor Terry Jones will get his protest, he told The Detroit News Saturday morning at the Detroit Metro Airport before boarding a plane to leave Michigan. And moreover, he announced plans to file a lawsuit against the Wayne County prosecutor's office and other entities within the next week.
Jones said Friday on a break during his trial at the 19th District Court that he planned to return to Dearborn's Islamic Center of America to protest Friday, April 29, if his Good Friday plans were thwarted.
However, Jones and his associate Wayne Sapp were arrested for refusing to post a $1 bond ordered by Judge Mark Somers, who also said that they must stay away from the mosque for three years.
Jones told The Detroit News that because he is filing a lawsuit, he will stay within the confines of the law and hold his demonstration within the free speech zone at Dearborn's City Hall when he returns at 5 p.m. next Friday.
Jones said he will be working with the Thomas More Law Center of Ann Arbor.
The ACLU of Michigan, for one, believes that the court wronged Jones in their decision to bar him from speaking in front of the mosque.
"We believe the prosecutor’s office and the Dearborn court has turned the first amendment on its head," ACLU communications director Rana Elmir said. "The judge should have dismissed this case (Thursday). Instead he played right into Mr. Jones’ hand, and gave them a platform."
Moreover, the prevention of Jones' speech constitutes prior restraint–a historically difficult judgment to levy against a person or organization.
"He’s being punished for speech that has never occurred," Elmir said. "That’s blatantly unconstitutional. There’s no question about it. His speech is distasteful and it’s offensive, but no one should face jail time for their ideas."
Elmir also pointed out that there are several court cases in which similar issues have gone before a judge, and free speech has won out. Most of them deal with something called a "Heckler's Veto," which Elmir explained is "when the government shuts down a speaker out of a fear that others’ reactions are going to be negative."
In Terminiello v. City of Chicago, 337 U.S. 1 (1949), a speaker was arrested to prevent him from stirring up a crowd of 1,000 protesters.The Supreme Court, in a decision penned by Justice William Douglas, found that "freedom of speech, though not absolute, is nevertheless protected against censorship or punishment, unless shown likely to produce a clear and present danger of a serious substantive evil that rises far above public inconvenience, annoyance, or unrest."
More recently–and in a case that the ACLU presented in their amicus brief to Dearborn's court during Jones' trial–Forsyth County v. Nationalist Movement, 505 U.S. 123 (1992) considered the constitutionality of the county's ordinance allowing a fee to be levied against a controversial speaker or demonstrator based on what the cost would be to police the event.
In that case, the Supreme Court held that "speech cannot be financially burdened any more than it can be punished or banned simply because it might offend a hostile mob."
In the case of Jones, Elmir said, they believe the similarities are clear.
"We believe that the Supreme Court has actually been quite clear on this issue in regard to speech," she said. "The government cannot place a price on free speech in order to silence demonstrators in anticipation that others will react negatively to their speech."

His constitutional rights were not violated at all. Do you not pay attention or do you seem to only here what you want and comment on only your view. He broke the law and got slapped with a $1 bond. He will return next week to demonstrate in an area where demonstrations are allowed. There is a difference from your constitutional rights and breaking the law. Once again you must picket in an area as allowed by law and not on private property. I agree with you that he has the right to picket as well as burn the koran. As a muslim I don't agree with his actions; however, I do believe in his constitutional right to do so. We must learn to live with it and deal with it the best we can. Believe it ir not most of us believe in his constitutional rights, it just seems people like you try to exploit the minority and make it seem it is the majority that opposes this. I welcome him back. the road that he wanted to march on is a private road owned by the church's and for the church's. The road is a one way in and a one way out, no other exits. Paster Jones would have to walk on the highway with traffic flowing at 50 miles an hour and that would people in harms way and with Michigan being a no fault state everyone would be in harms way including the pastor. He should protest like all muslims and that would be in an area that the City of Dearborn allows. There have been many protest and none by the churches and / or mosque.

Private property is private property and if Jones attempted to march on that, there are trespassing laws and harassment laws to deal with that. That is also the law. Someone check the street maps for the ownership. If the road is public, but tiny, he's got a right.

This is a most important issue and Americans need education - since we have dumbed down and not truly taught "Citizenship and Social Studies" in the elementary and high schools. I teach some college law classes and I am astounded at the ignorance of our students and lack of protection and understanding of our Constitution, laws and system of jurisprudence. Ismail, the whole purpose behind the right to protest is that it IS a venue event and is not to be unduly restricted by the state to exercise that right. The opnes promising violence should be the ones posting bond and arrested. If violence is perpetrated, those commiting the acts of violence are the ones to be punished, not the speaker or writer - THEY are the ones to be surrounded by a police vanguard if necessary to protect their right to protest. THAT right is what Americans shed blood to preserve.

Here's another thought - just ignore him. So what? he burns a koran - so what? go feed the hungry, adopt orphan children, build a garden, give of your time to make the earth a better place to live! Do I really care what book you burn? no. DO I really care what you wear in dress? no. or how long your hair is? no. do what you want - it's America, just do not physically cause tortious harm anyone. Dan you have a great point and you are very much correct. The way Jones was handled was Unconstitutional and he does have a case in his hand. Having to take him to court on an action he has yet to commit was wrongful and like you said in his favor and now he will keep coming back. Yet I do have to remind you "freedom of speech" is not absolute. I cant come to you screaming " I want to you kill you" and then say its my constitution right. So i hope not every thinks that they can do what they please because the law states it true. What ever happened to human moral and human conduct. Honestly I really hate the fact that this guy is getting much attention and like you said there are more dyer problems facing us, as american citizens than this fool.

Hey Ahmed, thanks. I know the moral thing and I know the insult thing - one tries to raise the bar by not resorting to that, BUT, it is Constitutionaly protected speech, and depending upon the circumstances, so would the shouting of "I want to kill you" - most likely however that would be an assault if coupled with affirmative action. The speech alone - "I want to kill you" without more? I believe it is protected. This is the beauty of free speech - no thought crimes as expressed through the tongue - the market place of ideas will decide what is significant or not, what rings true or not, but the "Hyde Park Soapbox" or the "corner Soapbox ranter" - flavor of the day!! Have to hit the P.L.I. books on Civil Rights and 42 USC 1983 cases - get some goodies of stare decisis/case law - not like we haven't been here before. We are sliding towards criminalization of speech, something antithetical to our way of life and our Constitution - we can not let that happen.

I live in Dearborn. I am white and think this man is a waste of life. That being said he had the right to demonstrate here. I hate the thought of him being here but he has the right. The supreme court ruled that those sick jerks can protest solders funerals and preach their hate and I am sorry but I am far more deeply offended by that then some wack job looking for headlines by burning a book. Sorry everyone but that's what it is, a bible, Koran, Miqra, take your pick they are all books written on paper by a publisher looking to get paid. Belief, values, morals which fall under the heading of religion are supposed to be inside a persons heart. Thank you for your relentless efforts in educating us all. your truly appreciated and we would love for you to join us. I'm just an ordinary citizen that has been in these united states for almost 40 years and frankly have been teaching our constitutional rights (best that i can) to all faiths for as long as I can remember. I'm not always right; however, I get my point across and in the end I almost always gain a friend. There's been times where on this website I get called a muzzie and told that we are animals and all deserve to die. I've been contributing to the well being of all faiths since I was a child. There weren't too many arabs in this area when I came to this country and we got along just fine.

I mean we got along with all faiths just fine. I've done polka dancing, my best friends are german, mexican and african american. I've enjoyed their traditions just as much as they have enjoyed mine to this day. Say what you will and do what you will and in the end justify your own actions and when you truly believe that you are doing the right thing then protest to best of your ability and rally the support; however, Mr. Jones owns a church and I believe his agenda is to gain monetary value by recruiting his own version of extremest by trying to condem a religion in a country that defends it just as much as it defends his constitution. I say remember that Jesus, moses, Joshua, mohammed, Abraham, and the rst of the prophets names that are in the old and new testament are also in the koran and by burning the book he burns their names as well and he calls himself a christian instead of an atheist who would have more reason to burn the books.

Thank you Ismail (good start to "Moby Dick") for being a patriot. We all bleed red - that is the way I was raised and that is how I raised my kids - we also understand human nature - the light and the dark. The point is to choose life and resist the insane. Jones is choosing money and fame - his right, stupid method. I'd rather be saving open space and getting a park bence inscribed with my name or educating the youth to be wise leaders or pushing biomass fuel use for a sustainable local energy production network and jobs. It's pointless to burn books (you may be burning a first edition os something and wouldn't that be a kick in the teeth!) - you can't burn ideas - if he were smarter he'd debate the ideas and let the populace decide - that what he has a pulpit for.
BTW, I am an atheist and I would never burn a book (unless we have no heat and we need energy - even then the thought of burning a first edition - sends shudders up the spine!).

Ismail please tell me the law he broke. It looks like to me he did not even get a chance to break a law just the fact he was going to insult the religion of peace was enough to get him put in jail, this just proves to me we need to stop immigration of muslims to this country. For those from countries where individuals have no rights I doubt they can understand the concept of the 1st amendment it also goes contrary to the muslim relgion. So to enlighten them lets apply the same law applied to Pastor Jones they are a threat to the greater American community they must all post 1 USD bond and refrain from leaving the Dearborn area for 3 years lest they insult the non muslims and generaly instigate danger just buy there words and the fact they believe in contrary to christians. no law was applied to Mr. Jones (a pastor he is not). The only law he broke was the law that of protesting in an area outside the protest area. I believe in his constitutional rights; however, your words of racism are also what the constitution protects. It never ceases to amaze me when muslim immigrants come to America they say they are fleeing the oppressive regime of there homeland , then they come to there adoptive country America , England , France etc etc. Instead of being grateful they start trying to change the country that gave them sanctuary to become like the very country that they were fleeing. The sheer arrogance of this ungratefulness makes a rational persons blood boil. No one asked you to come to America you or your ancestors asked for this PRIVILEDGE and now you have some numbers so the veil is lifted and you show you true character. If you think Dearborn is representative of most of the USA you are sadley mistaken. Most americans are Christians 83% and by the way I have native american blood so dont presume to know me. I might also add my wife is a Buddhist.
I guess my point escaped you I will spell it out again , a majority of non muslims perceive your religion to be be very hostile to other religions and other belief systems and if you look at the past 10 years your actions speak louder than words. Do i think all muslims are like this of course not but I do think people in your relgion should police the muslims thinking we live in the dark ages. i believe you missed my line when i said that I believed in his constitutional rights. I stood up for him on forums as well when protecting this. My issue with you is your approach and feeling of muslim people. Many muslims were given sanctuary from allies of this government and arrangements were made for these muslims to live while the United States blew up their country for their own political reason. I know that the Kuwaiti government pays Iraqi's living here for fleeing their country and waring. When the war stops and the United States and their allies rebuilds their country they should send them back home. It's amazing how you are disgusted with muslims yet country after country filled with muslims America leads the way to destroy what they've known fill them with promises and safe havens. These muslims do not know of this constitution yet you want them to abide by it.

Your statement of monetary value as a result of the city's action is just an assertion and nothing has been proven. Yes, I know that 80% of americans are Christian and I can assure you that 80% of the Christians don't agree with Mr. Jones.
